What to Do If Your Child Is Injured at Daycare in Wisconsin

You pick your child up from daycare and something is wrong.

Maybe they have a bruise no one mentioned. Maybe they say they fell, but the daycare’s explanation feels incomplete. Maybe you got a call hours after the injury happened. Or maybe your child is too young to explain what happened at all.

As a parent, that is an awful position to be in. You are trying to comfort your child, make sense of the story, and decide whether you are overreacting.

Let’s take a look at the steps you should take to protect your child, their health, and your claim if there is one. 

First, Get Your Child Checked

If your child is in pain, acting differently, vomiting, unusually tired, limping, guarding an arm or leg, or showing signs of a head injury, get medical care right away.

Even if the daycare says it was “just a fall,” you do not have to rely on their judgment. A doctor can help determine what your child needs and create a record of the injury.

Ask For The Incident Report

A daycare should be able to tell you what happened, who was supervising, where the injury occurred, and when they noticed it.

Ask for the incident report in writing. If the explanation changes from one staff member to another, write that down. If they say there is no report, write that down too.

Details matter, especially when a child cannot clearly explain what happened.

Take Photos And Save Messages

Take photos of the injury as soon as you notice it. Bruising and swelling can change quickly, so continue taking photos over the next few days.

Save every text, email, voicemail, app message, and note from the daycare. If you speak with someone by phone, write down the date, time, name, and what they told you.

Trust Your Instincts

Not every daycare injury means someone did something wrong. Kids fall. Kids bump into things. Kids get hurt while playing.

You may need to file a complaint with the Wisconsin Department of Children and Families, so they can investigate the matter further.  

But some situations deserve a closer look. For example:

  • No one can explain how the injury happened
  • The daycare waited too long to call you
  • Your child’s story does not match the daycare’s story
  • The injury seems too serious for the explanation given
  • Your child is suddenly scared to go back
  • The daycare wants you to sign something quickly
